05 Pricing & Payment

All prices displayed on our website are in Pounds Sterling (GBP £) and include VAT where applicable, unless otherwise stated.

Prices do not include:

• Road tax (unless otherwise stated)
• Insurance
• Delivery charges (unless specified)
• Any additional services requested by the customer

Accepted Payment Methods

We accept the following payment methods:

• Bank transfer (BACS / Faster Payments)
• Debit card
• Credit card (subject to processing fees where applicable)
• Cash (subject to legal limits)
• Finance (via approved third-party lenders)

We reserve the right to refuse any payment method at our discretion and to verify the identity of any customer before accepting payment.

06 Reservations & Deposits

A non-refundable deposit may be required to reserve a vehicle. The amount and terms of any deposit will be agreed in writing at the time of reservation.

If the sale does not complete through no fault of ours, the deposit may be forfeited. Deposits are usually refundable if:

• We are unable to supply the vehicle as described
• There is a material misdescription of the vehicle
• Both parties agree in writing to cancel

07 Finance & Credit

Finance is available subject to status and approval by our approved third-party lenders. We act as a credit broker and not as a lender.

By applying for finance, you consent to us sharing your information with lenders for the purpose of assessing your application. All finance agreements are regulated by the Financial Conduct Authority (FCA) where applicable.

08 Part Exchange

We accept part exchange of your current vehicle, subject to inspection and valuation. Any valuation we provide is:

• Based on the information you provide
• Subject to physical inspection of the vehicle
• Subject to verification of ownership, mileage, and history (HPI check)
• Subject to the vehicle being free from finance (unless settled as part of the transaction)

We reserve the right to revise or withdraw any part exchange valuation if the vehicle does not match the description provided, or if it is found to have outstanding finance, previous accident damage, or other issues not previously disclosed.

09 Warranty & After-Sales

All vehicles are sold with the protections provided by the Consumer Rights Act 2015. In addition, certain vehicles may be eligible for extended warranty coverage.

Any additional warranty provided by us:

• Is subject to the terms of the specific warranty agreement
• May exclude certain components or conditions of use
• Requires routine servicing in accordance with the manufacturer's schedule
• Does not cover normal wear and tear, consumables, or accidental damage

Full details of any warranty provided will be given in writing at the time of sale.

10 Delivery & Collection

Vehicles are usually collected from our premises in John Street HYDE SK14 2HB. UK delivery can be arranged on request, subject to an additional charge.

Where delivery is arranged:

• The delivery fee will be agreed in advance
• Delivery times are estimates and not guaranteed
• Risk passes to you upon delivery
• You or your representative must be present to accept delivery and inspect the vehicle

11 Cancellation & Refunds

Your statutory rights under the Consumer Rights Act 2015 apply to all purchases. In addition:

• Distance Sales: Where a sale is made online or by phone without prior physical inspection, you may have a 14-day right to cancel under the Consumer Contracts Regulations 2013
• Showroom Sales: Purchases made in person after inspection are generally not covered by the 14-day cancellation right
• Refunds: Refunds will be made using the original payment method within 14 days of an approved cancellation
• Return Costs: Where applicable, you are responsible for the cost of returning the vehicle to us

12 Limitation of Liability

To the fullest extent permitted by law, M & S Import LTD shall not be liable for:

• Any indirect, incidental, or consequential loss or damage
• Loss of profits, business, or opportunity
• Any loss arising from the use or inability to use our website
• Any loss caused by third-party services or content linked from our site

Nothing in these Terms limits or excludes our liability for:

• Death or personal injury caused by our negligence
• Fraud or fraudulent misrepresentation
• Any other liability that cannot be excluded by law
